Indiana Attorney General Todd Rokita, along with Idaho’s Attorney General and 24 other states, filed a brief in the Ninth Circuit Court of Appeals arguing that the Eighth Amendment does not mandate states to provide sex-change surgeries for prisoners.
The brief challenges a U.S. District Court order from Alaska requiring the state to refer a prisoner for surgical consultation, claiming it oversteps constitutional bounds and state authority over prison healthcare.
Rokita warns that upholding the order could set a national precedent forcing states to offer such surgeries in prisons.
